Terms of Use

1. The Service

PerkTap is a skill-based rewards game. Players earn virtual Coins through activity in the App, use Coins to open reward chests, and redeem the resulting Perks (discounts, freebies, and other benefits) at participating businesses ("Merchants").

PerkTap is not a gambling, lottery, or wagering service. See Section 5.

You must be at least 13 years old to use the App. By using the App you confirm you meet this requirement.

Reward Chests - Skill-Based Reaction Game

The PerkTap game mechanic operates as follows:

During each game round, targets (points) appear on-screen at varying positions and speeds. The Player must identify and tap each target accurately and in time. The score achieved - which determines the Coins earned and the Perk associated with the chest - depends entirely on the Player's speed, accuracy, and reaction, and on no other factor.

The Player does not stake or risk anything of monetary value. Coins spent to open a chest have no monetary value and cannot be purchased, exchanged for cash, or transferred.

The App therefore does not constitute a prohibited lottery, gambling activity, or wagering service under the Israeli Penal Law, 5737-1977, or any other applicable law. Outcomes are determined exclusively by the Player's skill and reaction time; no element of chance, concealed randomization, or monetary consideration is present. Nothing in these Terms shall be construed as authorizing wagering of any kind.

If PerkTap introduces future features that involve payment by Players - such as a paid multiplier or premium subscription - such features will be governed by supplemental terms presented to you at the time of introduction. PerkTap will not introduce any paid feature that affects the skill-based characterization set out in this Section 5 without updating these Terms in advance.

You must not:

• Use bots, scripts, emulators, or automation to earn Coins or open chests
• Exploit bugs (report them instead: support@perktap.app)
• Manipulate, duplicate, or forge Perk redemptions or QR codes
• Reverse-engineer, decompile, or interfere with the App
• Use the App for any unlawful purpose

We may suspend or terminate accounts, void Coins, and cancel Perks obtained in violation of these Terms.

8. Intellectual Property

The App, including its design, graphics, branding, and software, is owned by KOMPOZITZYA or its licensors. You receive only a personal, non-transferable, revocable license to use the App.

PerkTap may modify, suspend, or discontinue the App or any feature - including Coin earning rates, chest content, and the Perk catalog - at any time, at our sole discretion. We will provide reasonable notice in the App of material adverse changes to Coin or Perk rules. Your continued use of the App after the effective date of any change constitutes your acceptance of the updated Terms. If you do not accept a material change, your remedy is to stop using the App and delete your account per Section 12.

9. Changes to These Terms

PerkTap may update these Terms at any time. We will notify you of material changes through the App before they take effect, with reasonable advance notice. By continuing to use the App after the effective date of updated Terms, you accept those changes. If you do not accept a material change, your remedy is to stop using the App and delete your account in accordance with Section 12. Non-material changes (such as corrections of typographical errors or clarifications that do not affect your rights) take effect immediately upon publication.

10. Disclaimers

The App is provided 'as is' and 'as available'. We do not warrant uninterrupted, error-free, or continuous operation. PerkTap is a technology platform only. PerkTap is not a party to, and bears no responsibility whatsoever for, any transaction, act, omission, or failure on the part of any Merchant, including but not limited to: the availability, quality, safety, or legality of any Perk or underlying goods or services; a Merchant's refusal or inability to honor a Perk Ticket; Merchant closure; or any loss or damage arising from your interaction with a Merchant. Your recourse for Merchant-related issues is solely against the relevant Merchant.

11. Limitation of Liability

To the maximum extent permitted by law, PerkTap's total aggregate liability to you for all claims arising from or relating to the App, the Coins, the Perk Tickets, or these Terms - whether in contract, tort, or otherwise - shall not exceed NIS 100 (one hundred New Israeli Shekels). [COUNSEL TO CONFIRM BEFORE PUBLICATION - this cap may be challenged as unreasonable under the Consumer Protection Law, 5741-1981; consider whether to raise the cap or restructure.] PerkTap shall not be liable for any loss of Coins, loss of Perks, loss of data, or any indirect, incidental, special, consequential, or punitive damages, howsoever arising. Nothing in these Terms excludes or limits: (a) liability for death or personal injury caused by negligence; (b) liability for fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited under mandatory Israeli law, including rights under the Consumer Protection Law, 5741-1981.

12. Termination

You may stop using the App and delete your account at any time via Settings → Account → Delete Account. We may suspend or terminate your access for breach of these Terms, at our sole discretion, with or without prior notice depending on the severity of the breach. Upon termination for any reason: (a) your limited license to use the App ends immediately; (b) all remaining Coins are forfeited without compensation, as Coins are a revocable, limited license with no monetary value and cannot be returned or compensated; and (c) all unexercised Perk Tickets are void - except where mandatory Israeli law provides otherwise. Account deletion is permanent and irreversible; forfeited Coins and Perks cannot be restored under any circumstance. Provisions that by their nature should survive termination - including Sections 8 (Intellectual Property), 10 (Disclaimers), 11 (Limitation of Liability), and 13 (Governing Law) - survive termination.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Israel. Exclusive jurisdiction lies with the competent courts of Haifa, subject to any mandatory consumer-protection venue rules.

14. Apple App Store Terms

If you download the App from the Apple App Store, the following terms apply in addition to these Terms:

• (a) Acknowledgment: This agreement is between you and PerkTap only, not Apple. Apple is not responsible for the App or its content.
• (b) Maintenance and Support: PerkTap - not Apple - is solely responsible for providing any maintenance or support services with respect to the App, as specified in these Terms. Apple has no obligation whatsoever to furnish any maintenance or support services.
• (c) Warranty: In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation with respect to the App. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are PerkTap's sole responsibility.
• (d) Product Claims: PerkTap - not Apple - is responsible for addressing any claims relating to the App or your use of it, including: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
• (e) Intellectual Property: In the event of any third-party claim that the App infringes that third party's intellectual property rights, PerkTap - not Apple - will be solely responsible for the investigation, defence, settlement, and discharge of such claim.
• (f) Legal Compliance: You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a terrorist-supporting country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• (g) Third-Party Beneficiary: Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary. In the event of any conflict between Apple's mandatory standard EULA terms and these Terms, Apple's mandatory terms prevail to the extent of the conflict; these Terms govern in all other respects.
